Terms of Service

Introduction

Welcome to Streetwise ("we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the Streetwise iOS mobile application (the "App").

By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.


1. Account Eligibility

1.1 Age Requirements

You must be at least 16 years old to create an account and use the App. If you are under 16 (or 13 in certain jurisdictions with parental consent), you may not use the App.

1.2 Account Accuracy

  • You agree to provide accurate, current, and complete information when creating your account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access to your account

1.3 One Account Per Person

You may only create one account. Multiple accounts by the same person are prohibited.


2. Acceptable Use

2.1 Permitted Uses

You may use the App to:

  • Discover cities, photo spots, and travel content
  • Create and share photo spots, routes, and itineraries
  • Upload photos and content related to travel and photography
  • Organize or participate in photography workshops
  • Follow other users and interact with their content
  • Access curated travel articles and photography guides
  • Import your own photos from Instagram

2.2 Prohibited Conduct

You agree NOT to:

Content Violations:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful
  • Upload content containing nudity, sexually explicit material, or graphic violence
  • Share content that infringes on others' intellectual property rights
  • Post spam, advertisements, or promotional content without authorization
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

Technical Violations:

  • Attempt to gain unauthorized access to the App, servers, or databases
  • Use automated scripts, bots, or scrapers to access the App
  • Reverse engineer, decompile, or disassemble any part of the App
  • Introduce viruses, malware, or harmful code
  • Interfere with or disrupt the App's functionality or servers

Community Violations:

  • Harass, stalk, or intimidate other users
  • Create a hostile or unsafe environment for others
  • Discriminate against users based on race, ethnicity, religion, gender, sexual orientation, disability, or age
  • Organize or promote illegal activities through workshops or events

Location & Safety Violations:

  • Share photo spots on private property without permission
  • Encourage trespassing or dangerous photography practices
  • Provide misleading or false location information
  • Create workshop meeting points in unsafe or restricted areas

3. User-Generated Content

3.1 Your Content Ownership

You retain ownership of all content you create and upload to the App, including:

  • Photos and images
  • Photo spots and location data
  • Routes and multi-day itineraries
  • Workshop descriptions and materials
  • Comments and messages

3.2 License to Streetwise

By uploading content to the App, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to:

  • Display your content within the App
  • Store your content on our servers
  • Make your public content discoverable by other users
  • Use your content for promotional purposes (with attribution)

This license continues even after you delete your content, to the extent we need it for legal or operational purposes (e.g., cached copies, backups).

3.3 Content Visibility

  • Public Content: Photo spots, routes and itineraries marked as "public" are visible to all App users
  • Private Content: Content marked as "private" is only visible to you
  • Workshop Content: Shared only with accepted workshop participants

You control the visibility of your content through privacy settings.

3.4 Content Moderation

We reserve the right to:

  • Review and moderate user-generated content
  • Remove content that violates these Terms
  • Refuse to publish or distribute any content
  • Suspend or terminate accounts for repeated violations

We are not responsible for user-generated content and do not endorse any opinions expressed by users.

3.5 Instagram Import

The App allows you to import your own photos from Instagram. When using this feature:

  • You confirm that you have the right to import and use the photos you select
  • Imported photos are subject to the same content rules as any other uploaded content
  • You remain responsible for ensuring imported content does not violate third-party rights
  • Instagram's own Terms of Use continue to apply to your Instagram account and content

4. Workshops & Events

4.1 Workshop Organizers

If you create workshops, you agree to:

  • Provide accurate information about the workshop (date, location, requirements)
  • Ensure the workshop location is legal and safe to access
  • Take responsibility for participant safety during the workshop
  • Comply with local laws and regulations
  • Obtain necessary permits or permissions for the workshop location
  • Not discriminate in participant selection

4.2 Workshop Participants

If you join workshops, you agree to:

  • Follow the organizer's instructions and guidelines
  • Respect other participants and their property
  • Take responsibility for your own safety
  • Not hold Streetwise liable for injuries, damages, or losses during workshops
  • Share your real-time location with workshop participants when using workshop features

4.3 Workshop Liability

IMPORTANT: Streetwise is a platform for organizing photography workshops. We do not:

  • Verify the credentials of workshop organizers
  • Inspect workshop locations for safety
  • Supervise or monitor workshop activities
  • Assume liability for workshop-related incidents

Participation in workshops is at your own risk. You release Streetwise from all liability related to workshops.

4.4 Workshop Location Sharing

When you participate in an active workshop, your real-time location is shared with other accepted workshop participants for coordination purposes. This feature:

  • Requires your explicit permission (iOS location authorization)
  • Only works when you're viewing the workshop screen
  • Automatically deletes your location data after 24 hours
  • Can be stopped by leaving the workshop or denying location permission

5. Subscription & Payments

5.1 Subscription Tiers

Streetwise offers the following subscription tiers:

  • Free: Basic features (browsing cities, reading articles, viewing photo feeds)
  • Pro: Advanced features (create unlimited spots and itineraries)
  • Organizer: Workshop creation and management features

5.2 Payments

  • Subscriptions are billed through the Apple App Store
  • Prices are displayed in your local currency
  • Payment is charged to your Apple ID account upon subscription purchase
  • Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current period

5.3 Refunds

  • Refunds are handled by Apple according to their App Store refund policy
  • We cannot provide refunds directly
  • Contact Apple Support for refund requests

5.4 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period.


6. Itinerary Marketplace & Seller Responsibilities

6.1 Seller Status

If you sell itineraries or other content to other users through the App ("Seller"), you are acting as an independent creator, not as an employee, agent, partner, or representative of Streetwise. Streetwise is a platform that facilitates discovery and purchase of your content — we do not co-author, endorse, or take responsibility for any itinerary you sell.

6.2 Intellectual Property Warranty

By submitting any itinerary or paid content for sale on the App, you represent and warrant that:

  • You are the original author of the content, or you hold all necessary rights, licences, and permissions to sell it
  • The itinerary does not contain any text, photos, maps, routes, or other material that is subject to third-party copyright, trademark, or other intellectual property rights, unless you have obtained explicit written permission from the rights holder
  • The itinerary does not infringe any patent, trade secret, or contractual rights of any third party
  • You have the right to grant Streetwise the licence described in Section 3.2 in relation to your paid content
  • All location information, directions, and safety advice within the itinerary are accurate to the best of your knowledge

IMPORTANT: You may NOT include in a paid itinerary:

  • Maps or map excerpts from Google Maps, Apple Maps, Mapbox, or other providers unless you have a specific commercial licence to do so
  • Photos taken by other photographers without their explicit written consent
  • Text or descriptions copied from travel blogs, guidebooks, or websites
  • Any content generated using AI tools where the underlying training data may infringe third-party rights

6.3 Seller Indemnification

As a Seller, you agree to indemnify, defend, and hold harmless Streetwise and its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

  • Any claim that your itinerary or any content within it infringes the intellectual property rights of any third party
  • Any claim arising from inaccurate, unsafe, or misleading content in your itinerary
  • Your breach of the warranties set out in Section 6.2
  • Any tax liability arising from your sales activity on the platform
  • Any dispute between you and a buyer of your content

This indemnification obligation survives termination of your account.

6.4 Content Takedown & DMCA

Streetwise respects intellectual property rights and expects Sellers to do the same. If you believe that content available for sale on the App infringes your copyright or other intellectual property rights, please notify us by sending a written notice to info@mattiacompagnucci.com containing:

  1. Identification of the copyrighted work you claim has been infringed
  2. Identification of the infringing content (including its location in the App)
  3. Your contact information (name, address, telephone number, email)
  4. A statement that you have a good-faith belief that the use is not authorised by the rights holder
  5. A statement, made under penalty of perjury, that you are the rights holder or authorised to act on their behalf
  6. Your physical or electronic signature

Upon receipt of a valid notice, Streetwise will:

  • Remove or disable access to the allegedly infringing content promptly
  • Notify the Seller whose content was removed
  • Terminate the accounts of repeat infringers

Streetwise reserves the right to remove any content that we reasonably believe infringes third-party rights, at any time and without prior notice, and to suspend or permanently terminate the account of any Seller who repeatedly or flagrantly violates this policy.

6.5 Seller Revenue & Taxes

Sellers are solely responsible for:

  • Declaring and paying any income tax, VAT, or other taxes due on revenue earned through the App, in accordance with the laws of your country of residence
  • Complying with any local regulations that apply to selling digital content

Streetwise does not provide tax advice. We recommend consulting a qualified tax advisor.

6.6 Buyer Rights

Purchases of itineraries are processed through Apple's In-App Purchase system. Refunds are subject to Apple's standard refund policy. Streetwise does not guarantee the accuracy, completeness, or fitness for purpose of any user-generated itinerary. Buyers assume all risk associated with following advice contained in user-generated itineraries.


7. Intellectual Property

7.1 Our Content

All content provided by Streetwise (curated cities, articles, editorial photos, guides) is protected by copyright and other intellectual property laws. This content is owned by Streetwise or licensed from third parties.

You may not:

  • Copy, reproduce, or distribute our content outside the App
  • Use our content for commercial purposes without permission
  • Remove copyright notices or attributions

7.2 Trademarks

"Streetwise" and the Streetwise logo are trademarks of Streetwise. You may not use these trademarks without our written permission.

7.3 Third-Party Content

The App displays content from third-party sources (photographer profiles, city tourism sites, etc.). We do not own this content and are not responsible for its accuracy or legality.


8. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains:

  • What data we collect
  • How we use your data
  • Your privacy rights (GDPR, CCPA)
  • Data retention and deletion

By using the App, you agree to our Privacy Policy.


9. Termination

9.1 Termination by You

You may delete your account at any time through the App's settings. Deletion is permanent and cannot be undone.

9.2 Termination by Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in prohibited conduct
  • You abuse the App or harm other users
  • Required by law or legal process
  • We discontinue the App

9.3 Effect of Termination

Upon termination:

  • Your access to the App will be revoked
  • Your user-generated content will be deleted (subject to legal retention requirements)
  • Your subscription will be canceled (no refund for remaining time)
  • These Terms will continue to apply to any disputes arising before termination

10. Disclaimers & Limitations of Liability

10.1 "As Is" Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the App will be error-free or uninterrupted
  • Warranties that user-generated content is accurate or reliable

10.2 Limitation of Liability

To the maximum extent permitted by law, Streetwise shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Personal injury or property damage resulting from your use of the App
  • Damages arising from user-generated content or third-party actions
  • Damages arising from workshop participation

Our total liability to you shall not exceed the amount you paid to us in the past 12 months, or $100, whichever is greater.

10.3 Location & Safety Disclaimer

IMPORTANT WARNING: Photo spots, routes, itineraries, and workshop locations are user-generated and may be:

  • Inaccurate or outdated
  • Located on private property
  • Unsafe or difficult to access
  • Subject to local restrictions or permits

Always:

  • Verify location legality before visiting
  • Respect private property and local laws
  • Assess your own safety and abilities
  • Carry appropriate gear and emergency contacts

You assume all risks associated with visiting user-generated locations.


11. Indemnification

You agree to indemnify, defend, and hold harmless Streetwise and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your user-generated content
  • Your use of the App
  • Your participation in workshops
  • Your violation of third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Italy, without regard to conflict of law principles.

12.2 Arbitration Agreement

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except:

  • Small claims court disputes
  • Intellectual property disputes
  • Violations of these Terms

You waive your right to a jury trial and class action lawsuits.

12.3 Exceptions

The arbitration agreement does not apply to disputes that can be brought in small claims court or injunctive relief for intellectual property violations.


13. General Provisions

13.1 Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Sending an in-app notification
  • Updating the "Last Updated" date at the top

Your continued use of the App after changes constitutes acceptance of the updated Terms.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Streetwise regarding the App.

13.4 No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

13.5 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any successor or affiliate.

14. Apple-Specific Terms

As required by Apple's App Store guidelines:

14.1 Acknowledgment

You acknowledge that these Terms are between you and Streetwise only, not with Apple, and Apple is not responsible for the App or its content.

14.2 License Scope

The license granted to you is limited to a non-transferable license to use the App on Apple-branded products you own or control as permitted by Apple's Usage Rules.

14.3 Maintenance & Support

Apple has no obligation to provide maintenance or support for the App. Contact info@mattiacompagnucci.com for support.

14.4 Warranty

Apple is not responsible for addressing any claims related to the App, including:

  • Product liability claims
  • Claims that the App fails to conform to legal requirements
  • Claims arising under consumer protection laws

14.5 Intellectual Property

Apple is not responsible for investigating, defending, settling, or discharging any third-party intellectual property infringement claim related to the App.

14.6 Third-Party Beneficiary

Apple is a third-party beneficiary of these Terms and may enforce them against you.
